What Happens in Ulster County Traffic Court?-
Negotiation before trial – The three main people involved in a Town of Ulster traffic court case are the police officer, the defense lawyer and the judge. Sometimes, there is also a prosecuting lawyer.
-
Reducing the charges – Often a plea bargain/settlement can be reached before the hearing begins. Sometimes charges can be dismissed. Other times several charges can be merged into one offense. Some charges can be reduced. For example, some speeding tickets can be reduced from 21-30 mph over the speed limit to 11-20 mph or even 1-10 mph over the speeding limit. Sometimes a moving violation can be reduced to a non-moving violation.
Through my experience trying numerous cases, I know the factual and legal arguments to make that can help persuade the police officer and the prosecutor. I also know, because of prior work with many of the officers and prosecutors, where they are likely to bargain and where they’re not. It helps to know which arguments, which weaknesses in the government’s case and which defenses the local judge will affect the judge’s decision.
-
Learn your defenses – You have a right to assert your defenses. If the defenses are factual, it helps if you appear. Most defense are legal, so you don’t have to appear. As your lawyer, I can assert the legal defenses. The defenses will differ depending on the actual charge, what the police officer/prosecutor can really prove and the facts of the case
-
Understand the effects of the judge’s decision – Your charges will be dismissed (if you’re found not guilty):
- Your convictions will be sent to the NY Department of Motor Vehicles
- You may have to pay a fine, penalty or court costs. If the charges have been reduced, you will have to pay much less. If I cannot have your charges dismiss, I aim to have them reduced
- Convictions may be forwarded to the state or country that issued your license
- Your insurance premiums may increase
- Your license may be suspended or revoked
A speeding ticket and other traffic violations can put points on your driver’s license or affect your right to drive. Too many points can lead to an increase in your insurance premiums and the possible suspension or revocation of your license.
